Boston: Eight days in prison have been imposed on a Philadelphia woman who was involved in a plot to distribute kilograms of heroin and fentanyl. A 37-month prison term was suggested by the government.
Elba Pena, 34, was sentenced by U.S. District Court Judge Allison D. Burroughs to time served (eight days), three years of supervised release, and one year of home confinement, according to the Massachusetts Department of Justice. Pena entered a guilty plea to one count of conspiring to possess heroin and fentanyl with the purpose to distribute them.
Pena made the trip from Philadelphia to Methuen, Massachusetts in November 2021 in order to deliver two kilograms of heroin to a person she believed to be a client. Pena specifically met with an undercover cop posing as the alleged customer at a business plaza in Methuen on November 16, 2021, and provided the heroin. Pena was brought into custody right away. Nine kilograms of fentanyl were found during a later search of Pena’s Philadelphia home.
The statement was delivered by Special Agent in Charge of the Drug Enforcement Administration’s New England Field Division, Brian D. Boyle, and Acting United States Attorney Joshua S. Levy. The case was prosecuted by Assistant U.S. Attorney Samuel R. Feldman of the Narcotics & Money Laundering Unit.
